  1. What Is The Scope Of This Privacy Policy?

In this Policy, you will find all relevant information applicable to our use of our ‘customers/ consumers' personal data.  This Privacy Policy is applicable to customers of the Chakra, including current, former, potential customers and recipients of a product or service offered by us, visitors to our Shopify e-store mychakrastore.com.

In other words, CHAKRA MAĞAZACILIK TİCARET VE A.Ş. (“We”, “Us” “Chakra” or “the Controller”) is Controller of the data. This means that we are responsible for processing and protecting your personal data.

  1. When Can We Process Your Personal Data?

We are not allowed to collect, process, use or store personal data without a valid lawful basis.

Lawfulness may be derived from the following basis:

4.1. Consent: When you give us your consent, we will process your personal data for the specific purpose you have consented to. This basis is for example used when you request us to send you one of our newsletters with offers and style updates or when you purchase an item from our Shopify store we will be able to send you a notification about your order status.

4.2. Contract: When making products and services available to you we will process your personal data necessary for fulfilment of a contract (such as purchase agreement) with you and to fulfil any obligations derived from that contract.

4.3. Legitimate Interest: We may process your personal information when necessary for our legitimate interests and when these interests do not outweigh your own rights and interests. 5.1. Online Shopping

To be able to process your purchase order and handle payment transactions

To be able to manage your deliveries, claims, warranty matters, returns and refunds in a secure and effective manner and to be able to notify you of the details and the status of such matters.  

To be able to deliver and follow-up requested services including discount codes, on the website or app, identify and contact you when needed.

In these situation we only process, Contact information (e.g., phone number, email address, delivery address), Member ID (when applicable) and transactional data, Payment method information.

Lawful basis: When making products and services available to you we will process your personal data necessary for fulfilment of a contract with you and to fulfil any obligations derived from that contract, whether the contract refers to a purchase order and payment, or the use of other services provided by us or by third parties. When you need to make a return or claim a consumer right, we will process your personal data to fulfil obligations derived from concluding a contract with us, whether the contract refers to a purchase transaction, or the use of other services provided by us or by third parties. For any other purpose referred to herein, the process of your personal data is based on our legitimate interest as a business.

We will keep and process your personal data no longer than necessary for us to perform our contractual and consumer obligations.

To be able to protect our customers, users, visitors, assets and business against violence, fraud, theft, misuse and other malicious activities.

We will keep your personal data no more than necessary for each purpose.

To comply with certain legal obligations. In order to comply with local law, we are obliged to process certain personal data. Such obligations may vary from country to country stipulated in for example tax, accounting, book-keeping, sanctions, and consumer legislations. The data retention time will vary depending on the purpose, context and specific local legal requirements.

5.4. Content Shared By You

To be able to provide you with a service for customer engaged marketing.

To be able to share your photos and/or videos on our official websites, on our social media pages and in other promotional channels.

In these situations we only process; Photo, Video, Username, Credit Card/ Debit Card Information.

Lawful basis: The processing of your personal data is based on the contract of the service that you have agreed to. 

  1. Where and With Whom Do We Share Your Personal Data?

Your personal data is available and accessible only by those who need the data to accomplish the intended processing purpose. We may share your personal data within the CHAKRA, with sub-contractors, partners and other third parties whenever needed to fulfil the intended processing purpose.  

We reserve the right to transfer any personal data we have about you in the event that we merge with or are acquired by a third party, undergo other business transactions such as a reorganization, or should any such transaction be proposed. 

The personal data that we collect from you is processed within a country of the European Union or the European Economic Area (“EU/EEA”) but may also, whenever necessary, be transferred to and processed in a country outside of the EU/EEA. Any such cross-border transfer of your personal data will take place only if permitted and carried out in compliance with applicable laws and without undermining your statutory rights. From time to time, we may transfer personal data from the EU/EEA to a third country not being approved by the European Commission as a safe country for such transfer. Whenever applicable we will use the European Commission’s Standard Contractual Clauses, e.g. a set of contractual terms and conditions which both the sender and the receiver of the personal data sign up to and ensure that the rights and freedoms of the individual are considered. The time for which we will keep your data will depend on the purposes for which we process them, as explained below:

7.1. To manage your Platform user registration. We will process your data for the time during which you remain a registered user (meaning, until you decide to delete your account).

7.2. Development, performance and execution of the purchase or services contract. We will process your data for the time necessary to manage the purchase of the products or services that you buy, including potential returns, complaints or claims related to the purchase of the product or service in question. Sometimes, we will only process the data until the time when you decide, as is the case of payment data that you requested us to store for future purchases (where this feature is available). 

7.3. Customer Support. We will process your data for the time necessary to meet your request or application.

7.4. Marketing. We will process your data until you unsubscribe or cancel your subscription to the newsletter. Likewise, we will show you personalized ads until you change your device, browser and or cookies settings so that permission to do so is revoked.  If you participate in promotional actions, we will keep the data during a six (6) months period from the end of the action. 

7.5. Analysis of usability and quality. We will process your data occasionally for the time during which we proceed to carry out a specific quality action or survey or until we anonymize your browsing data. Notwithstanding the fact that we will process your data for the time strictly necessary to achieve the purpose in question, we will subsequently keep them duly stored and protected for the time during which liability may arise for their processing, in compliance with legislation in force from time to time. Once each of the potential actions is time-barred we will proceed to delete the personal data.

Data protection is a fundamental right, and you have several rights in accordance with applicable data protection legislation. These rights are:

8.1. Right to access: You have the right to request information about the personal data we hold on you at any time. 

8.2. Right to portability:  Whenever we process your personal data, by automated means based on your consent or based on a contract, you have the right to get a copy of your data transferred to you or to another party. This only includes the personal data you have submitted to us.

8.3. Right to rectification:  You have the right to request rectification of your personal data if the information is incorrect, including the right to have incomplete personal data completed.

8.4. Right to erasure: You have the right to erase any personal data processed by us at any time except for the following situations:

  • You have an ongoing matter with Customer Service,
  • You have an open order,
  • You have an unsettled balance with us,
  • If you have made any purchase, we will keep your personal data in connection to your transaction for book-keeping purposes,

8.5. Right to restriction: You have the right to request that we restrict the processing of your personal data under the following circumstances:

  • If you object to a processing based on our legitimate interest, we will restrict all processing of such data pending the verification of the legitimate interest,
  • If you have claimed that your personal data is incorrect, we must restrict all processing of such data pending the verification of the accuracy of the personal data,
  • If the processing is unlawful, you can oppose the erasure of personal data and instead request the restriction of the use of your personal data instead ,
  • If we no longer need the personal data but it is required by you to defend legal claims. Right to withdraw your consent; for each processing purpose you have given us your consent, you have the right to withdraw your consent at any time,

If you do so, we will stop the processing of your personal data for that specific purpose. If you, however, continue to receive marketing communication from us displayed in your social media feed or web browser, this is a matter entirely between you and your platform provider.

You can revoke your consent or object from further marketing communication by the following means:

  • following the instruction in each marketing post,
  • by editing the settings of your account,
  • configurate the privacy settings on your social media account or browser,
  • contact Customer Service,
  • disable your account on Shopify.

8.6. Right to object to processing based on our legitimate interest

You have the right to object to processing of your personal data that is based on our legitimate interest. We will not continue to process the personal data unless we can demonstrate legitimate grounds for the process which overrides your interest and rights or due to legal claims.

If you have an account on Shopify or if you gave your personal information to us while purchasing an item, you can exercise your right to access, portability and rectification under your account pages, where you also can delete your account or reach us to delete your personal information from our global database. We may amend the information contained in this Policy when we consider this appropriate. Should we do so, we will notify you by various procedures through the Platform (for example, through a banner, a pop-up or a push notification), or we may even send you a notice to your e-mail address when the change in question is relevant to your privacy, for you to be able to review the changes, assess them and, as the case may be, object or unsubscribe from any service or functionality. In any case, we suggest you to review this Policy from time to time in case minor changes are made or we make any interactive improvement, taking the opportunity that you will always find it as a permanent point of information on our e-store.
